CHESSWYZE PRIVATE LIMITED (the “Company,” “We,” “Us,” or “Data Fiduciary”) is a Private Company limited by shares, with its Registered Office situated in the State of Delhi.

By accessing or using our mobile and web properties (the “Platform” or “App”) and services, you, the User (the “Data Principal”), agree to be bound by these Terms and Conditions.

PART I: INTRODUCTION, COMPANY, AND TECHNOLOGY

1. Company Identity and Technology

• Data Fiduciary: The Company is CHESSWYZE PRIVATE LIMITED. Our main objects are the development, operation, and provision of online platforms for chess games, puzzles, and lessons, and the facilitation of online training, teaching, and coaching services.

• Technology & Infrastructure: The Company operates this Platform/App, which utilizes the proprietary technology, infrastructure, and code licensed from/owned by KRT DIGITAL (the technology provider) and marketed under the brand Gamewyze. This arrangement allows us to efficiently run chess tournaments and other services.

• Applicability: By visiting our apps, you are consenting to these Terms and Conditions.

2. Amendments and Non-Acceptance

• Right to Amend: We reserve the right to amend, modify, update, or terminate these Terms at any time by publishing new Terms.

• Notification: We may notify you of any change via your registered email address or by posting notifications in your account.

• Denial of Access: If you do not accept the modified Terms, you must exercise the option to indicate non-acceptance within the prescribed timeframe. If you fail to do so or explicitly reject the changes, we reserve the right to deny access to the Platform and Services.

PART II: DIGITAL PERSONAL DATA PROTECTION (DPDP) COMPLIANCE

This section clarifies your rights as the Data Principal and our obligations as the Data Fiduciary under the DPDP Act, 2023, and Rules, 2025.

3. Principles of Consent and Notice

• Consent Standard: Any processing of your Personal Data is based on your Consent, which must be free, specific, informed, unconditional, and unambiguous, and provided through a clear affirmative action.

• Notice to Seek Consent: When processing is based on Consent, it shall be accompanied or preceded by a Notice that clearly informs you of:
  1. The itemized description of the Personal Data to be processed.
  2. The specific purposes of such processing.
  3. The process for exercising your Data Principal Rights, including the right to withdraw Consent.

• Withdrawal of Consent: You may withdraw your Consent at any time by contacting us at contact@gamewyze.com.

4. Data Collection and Purpose Limitation

• Personal Data Collected:
  1. User Identification: Mobile Number and Google/Email account name (for unique user identification and authentication).

1. Voluntary Data: Name, phone number, and email address (voluntarily provided by you).

• Purpose of Processing (Usage): The collected information is used only for the specified purposes required for the lawful functioning of the Platform and Services:

1. To facilitate app usage (account creation and full feature access).
2. To analyse usage data and improve user experiences.
3. To serve advertisements using third-party services like Google AdSense.
4. To prevent fraudulent activity on the App.
   

• Financial Data: We do collect financial data such as bank transfer details, UPI information etc in order to smoothly process prize money distribution. We may also offer subscription services for learning modules. However, in such cases the financial data will not be stored.

5. Data Sharing, Security, and Breach

• Data Sharing (Data Processor): We share your information with trusted third parties, including our technology provider, KRT DIGITAL, who acts as a Data Processor by processing data on our behalf to operate the app. We may also integrate other services with time. Your personal information will never be shared with unrelated third parties for marketing or promotional activities.

• Security Safeguards: We are obligated to implement reasonable security safeguards to protect your personal data from unauthorized access, misuse, or breach.

• Data Breach Notification: In the event of a personal data breach, we will notify both the Data Protection Board of India (DPBI) and every affected Data Principal as soon as it is reasonably practicable.

6. Data Principal Rights and Obligations

• Right of Access: You have the right to request a summary of the Personal Data being processed by us and the processing activities in relation to that data.

• Right of Correction and Erasure: You have the right to request the correction, completion, or updation of your Personal Data, and the right to request the erasure of your data when the purpose for which it was collected is no longer being served.
• Storage Limitation: We shall cease to retain your personal data as soon as the specified purpose is fulfilled, unless retention is necessary under applicable law.

• Obligations of the Data Principal: You warrant that the Personal Data provided by you to the Company is accurate, complete, and consistent.

PART III: USER ELIGIBILITY, FAIR PLAY, AND REFUNDS

7. Age and Eligibility

• Minimum Age: There is no minimum age for using our apps and web properties.

• Children’s Privacy: The app is safe for children under the age of 5. We prohibit processing that may cause harm to a child and prohibit targeted advertising toward children.

• Minor Usage: If a minor or person not competent to contract uses your ID, you are solely responsible and liable for their actions, and shall indemnify the Company against any resulting loss or litigation.

8. Games of Skill and Fair Play

• Game Type: The games hosted on the Platform are purely games of skill under Indian law, and the outcome is directly dependent on the Users’ effort, performance, and skill. We do not support, endorse, or offer any game of chance.

• Prohibited Activities: You agree not to indulge in any unfair game practice that may provide an undue advantage to you or any other User. This includes, but is not limited to, collusion, using automated devices, software, or means to access or interfere with the Platform.

• Penalties for Violation: We reserve the right to impose monetary penalties, temporarily suspend, or permanently deactivate the account of any User found in violation of these Terms. Any subscription amounts deposited by such User shall stand forfeited.

9. Game Mechanics, Disconnection, and Cancellation

• Match Control: Opponents, color (Black/White), and match resolution are automatically decided by the system.

• Forfeit Conditions: You will automatically forfeit the match if you: do not join the match within 2 minutes of the start time; abort the match mid-way; or exhaust your allocated time while the opponent has time remaining.

• Liability: We are not accountable for any disconnections, lag, or interference in your network. No refund will be issued for inability to play due to customer-side issues (e.g., slow internet, faulty hardware).

• Cancellation by Company: In case of technical failures, server crashes, breakdowns, low participation or malfunction of service at our end, we reserve the right to cancel the Game(s).

10. Return and Refund Policy

• Subscription Non-Refundable: Any subscriptions made by a player are not refundable under normal circumstances, once the player has subscribed to the platform.

• Processing: Any successful claims for refunds (e.g., due to cancellation by the Company) will be processed within 7 working days in the original payment mode.
