The User may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms, policies, rules, regulations, and terms of use referred to herein or provided by Company. If such options to indicate non-acceptance are not exercised by the User within the time frame prescribed in the email or notification, the User will be deemed to have accepted the modified Terms, policies, rules, regulations, and terms of use referred to herein or provided by Company. If the User does not accept the modified Terms, policies, rules, regulations, and terms of use referred to herein or provided by Company, we reserve the right to deny access to the Platform and Services to the User.

KRT Digital and its brand Gamewyze and all mobile and web properties under the umbrella of KRT Digital are committed to protect your privacy online. We strive to collect only the minimal personal data necessary for the operation of the apps. This may include your Google account name or Mobile number for user authentication. However, we may also integrate third-party services like Google Sign-In, Google Analytics and Google AdSense, which may collect additional types of information. The term personal information is defined as your personal details which you voluntarily provide us with your name, phone number and email address.

Following information is collected as part of usage of the app:

1. Mobile Number – To identify unique users

The information you provide is used to process user interactions, send periodic emails and improve the service we provide. We do share your information with trusted third parties who assist us in operating the app. Your personal information will never be shared with unrelated third parties. Specifically, we may use your information and data to:

*To facilitate app usage: Creating an account using your mobile number allows you to use all features on our App.

*To analyze usage : The usage data we collect helps us understand how our services are being used, allowing us to improve user experiences.

*To serve ads: We may use third-party services like Google AdSense to display advertisements that may be relevant to you.

*To prevent fraudulent activity on our App.

The information provided by users will never be shared with 3rd parties for use in any marketing or promotional activities.

Financial Data :

Financial data is data that is related to your payment method such as credit card or bank transfer details. We do not collect financial data.

Children ‘s Privacy :

The app is not intended for children under the age of 5. We do not knowingly collect or store information from children under 5. If you are a parent or guardian and you are aware that your child has provided with personal information, please contact us so that we will be able to do necessary actions. In the event a minor or any third-party individual or a person not competent to enter into a contract is using or playing through the id of the registered individual then the same shall be the responsibility and liability of the registered user. He shall keep the company indemnified at all times for any loss, litigation, complaints or damage to the reputation of the company or directors. Our company as a policy disclaims any liability for transfer, proxy usage and/ or misuse of the accounts of registered user.

You must be over 18 years of age and a resident of India to access and/or use our Platform and create an Account with us. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 18 years old; (b) you have not previously been suspended or blocked from using the Platform; and (c) your registration and your use of the Platform is in compliance with any and all applicable laws and regulations. You must not be a resident of any Restricted Territories (as hereinafter defined) to participate in any Games on the Platform. We reserve the right to request proof of identity at any stage to verify that minors are not using the Platform and we may exclude a person from accessing or using the Platform if proof of identity is not provided or if Company suspects that a person is under the age of 18 years. Parents and guardians should monitor their children’s / ward’s online activities and consider using parental control tools available from online services that help provide a child an amicable online environment. These tools can also prevent children from disclosing any personal information without parental permission. Employees and directors of the Company are not eligible to participate in any Games on the Platform.

Security :

We maintain security measures to protect your personal information from unauthorized access, misuse or disclosure. However, no exchange of data over the Internet can be guaranteed as 100% secure. While we make every effort to protect your personal details shared with us. You acknowledge that the personal information you voluntarily shared with us through our app can be accessed by a third party. You agree that we are not responsible for any intercepted information shared through app without our knowledge or permission. You release us from all claims arising out of or related to the use of such intercepted information in any unauthorized manner.

Cookies :

Cookies are files with small amount of data that are commonly used as anonymous unique identifiers. These are sent to your brower from the websites that you visit. This service doesn’t use these cookies explicitly. However, the app may use cookies through third-party services like Google Analytics to improve your user experiences. They just allow us to collect data to optimize your experience on the app.

Fair Play :

In accessing or using our Platform you agree that you will not:

use any automated device, software, process or means to access, retrieve, scrape, or index our Platform or any Content thereon without our express prior written consent;

use any device, software, process or means to interfere or attempt to interfere with the proper working of our Platform;

undertake any action that will impose a burden or make excessive traffic demands on our infrastructure that we deem, in our sole discretion, to be unreasonable or disproportionate site usage;

use or index any Content or data on our Platform for purposes of competing with us in any manner that we have not specifically authorized; transmit spam, chain letters, games, junk email, surveys, or other mass messaging, whether commercial in nature or not;

use our Platform or any Content there from in any manner which is, in our sole discretion, not reasonable and / or not for the purpose it is made available;

violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;

pose as any person or entity or attempt to solicit money, passwords or personal information from any person;

act in violation of any Terms of using our Platform;

reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit our Platform or any Content thereon, except as expressly authorized by us; or

transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature.

Company reserves the right to deny its Platform/ Services to any User at its sole and absolute discretion. Such denial would automatically disqualify a User from playing any Games hosted on the Platform.

We will track game play of all Users and strict action will be taken against any User(s) caught colluding. By agreeing to these Terms, you agree not to indulge in any unfair game practice that may provide undue advantage to you or any other User.

In the event any User is found undertaking such activity on the Platform, Company shall be entitled, at its sole and absolute discretion, to suspend or terminate such User’s account. Company reserves the right to permanently block the account of the User involved in such activity. Any subscription amounts deposited by such User on the Platform shall stand forfeited. Company reserves the right to impose monetary penalties on Users found to be undertaking such practices on the Platform.

We reserve the right to withhold any necessary action, as it deems fit, against Users found indulging in unfair means. The action could include, inter alia, monetary penalties, temporary account suspension, and/or permanent account deactivation. Any User involved in violation of these Terms is liable for prosecution.

Any User deemed to be a fraud User for any reason, for example, found depositing or withdrawing from/to a fraudulent account, is subject to legal action from the Company’s management including but not limited to the confiscation of the User’s Subscription Balance and locking of the User’s Account.

Any subscription balances of user, whose account is suspended or frozen, will be forfeited within thirty (30) days of account suspension.

By using the Platform, including any subdomains of the Platform, or related top-level domains including mobile sites, apps, APIs and widgets and/or registering yourself with us, you authorize us or our representatives to contact you via email or phone call or SMS including third party messaging apps to offer you our services including but not limited to impart product knowledge, offer/explain any promotional offers running on the Platform and offers offered by third parties, for which reasons, personally identifiable information may be collected. Irrespective of the fact that you have registered yourself under DND or DNC or NCPR service, you still authorize us or our representatives to contact you by any means aforementioned for the above-mentioned purposes or any other related purpose till the time you are registered with us or even after cessation of registration.

Changes to this Privacy Policy:

We reserve the right to change this Privacy Policy at any time. Changes will be posted on this page with the updated revision date.

Game Rules :

1. Skill Based Chess games played on the Platform do not qualify as Gambling and Lottery.
2. Only games of skill are hosted on the Platform.
3. Users acknowledge that the Games hosted on the Platform are games of skill under Indian law, and that we do not support, endorse, or offer to Users any game of chance. While games of skill do not have a comprehensive definition, they are considered to be those games where the impact of a player’s effort and skill on the outcome of a game is higher than the impact of luck on the outcome of a game.
4. Games hosted on the Platform are games of skill, as the outcome / success in the game is directly dependent on the Users’ effort, performance and skill. The Supreme Court of India has recognized that the right to play games of skill is a constitutionally protected right.
5. The matches are timed games with limited total time allotted to each participant. Hence participants are required to join the match on time to avoid losing on time.
6. The tournaments will be based on multiple elimination rounds, where winner of each round will progress to next round and the loser of a round will automatically exit the tournament.
7. The players and their opponents for each round will be automatically decided by the system and cannot be controlled by individuals.
8. Black/White will be automatically alloted to each participant and not decided by the individual.
9. Participants cannot decide the winner by themselves or whether to draw the match or not. These decisions will be automatically taken by the system.
10. Winner of a match will be decided as follows:
    • If a participant checkmates the opponent, that participant wins
    • If a participant decides to abort the match mid-way, the opponent automatically wins
    • If either of the participants does not show up for the match, their opponent automatically wins
    • If the game is still not finished, but a participant exhausts all of the allocated time, the opponent with time remaining wins.
    • In case a game is drawn, whichever participant has more time remaining automatically wins.
11. The match will be considered started as soon as one of the participants joins the match.
12. If a participant does not join the match within 2 mins of start time, they will forfeit the match automatically.
13. Once the match starts, the timer will keep running even if the participant navigates away from the app. This includes not accessing the app due to connectivity issues. It is the participant’s responsibility to ensure their availability during the entire tournament duration.

14. You understand and acknowledge that once a game has commenced, not being able to play due to slow internet connections, faulty hardware, technical failure due to customer’s hardware, internet connection failure, low computer configuration or for any other reason not attributable to us does not require us to issue a refund of the participation amount you may have paid for participation.

    In case of any technical failures, server crashes, breakdowns, software defects, disruption or malfunction of service at our end, as a policy, we will cancel the Game(s) and you accept that we are not responsible to you in all such cases. For any game, we have the right to cancel the game. In no case, other than a server crash, are we accountable for any of the User’s disconnections from the server.

    We do not hold any liability to any disconnection, lag, freeze or interference in network on the User’s computer or any other external networks.

15. There will be short breaks between each successive round. It is the responsibility of the participants to join the next round on time. As mentioned above, timer starts the moment one of the participants joins and more than 2 min delay in joining results in forfeit.
16. The tournament may be cancelled in cases such as:
    • Not enough participation
    • Server downtime
17. In case of cancellation due to participation not being enough, the players will be notified before the start time.
